1 Introduction
1.1 KYHU, a société par actions simplifiée (simplified joint stock company) with its registered office at 21, rue d'Abbeville, 75009 Paris, registered with the Paris Trade and Companies Registry under number 820 177 301 (hereinafter referred to as "KYHU", or "we", "us" or "our"), offers games that will amuse and entertain young and old alike. We respect the privacy of all users of our games (including, but not limited to, the Olé Mains! game) made available through, but not limited to, the Apple App Store (the "Game" or "Games"), our website at www.olemains.com (the "Site") and any related services that we or our group companies may offer to you at any time (including the Games and the Site, the "Services"). In this document, KYHU may be referred to as "KYHU", or "we", "us", "our", and you as "you", "your" or "yours".
This document, referred to as the "Privacy Policy", describes how we collect, process and store your personal data, that is, information about you that personally identifies you, such as your name, address, telephone number and e-mail address. In this document, this information may be referred to as "Personal Information" or "data".
By accessing and/or using the Services, you consent to the collection, processing, storage and sharing of your Personal Information by us in the manner described in this Privacy Policy. If you do not wish to provide us with data, or if you do not want us to use it as permitted by this Privacy Policy, you should not use our Services. In accordance with the terms of use of our Services, you must be at least 12 years old to access and use them.

3 Nature of information collected and methods of collection
3.1 We may collect and process the following data about you:
- information you provide to us via forms when accessing and/or using the Services, or when you create an account to use our Services;
- details about your use of our Services and the resources you access (for example, information about how and when you play our Games, or how and when you access our Site, the type of device you use to access our Services, or information about profile views, as defined in paragraph 6 below);
- content of messages sent via our messaging system; copies of correspondence in case of contact with our services or response to messages and communications sent to you;
- interactions with us on our social networks, including: Facebook, Instagram and Twitter;
- information that may be collected from third parties who hold data about you and agree to share it with us;
- information we collect via cookies and other similar technologies, as explained in more detail below.
Cookies and advertising
We use cookies and other similar technologies as part of our Services. These technologies work by either (i) placing a small file on your computer or mobile device that stores information; and/or (ii) accessing information on your device.
We use cookies and similar technologies to :
allow us to recognize you and your device, for example by identifying your IP address;
- enable our Services to interact with a third party social network or platform (if you have authorized such interactions);
- authorize the companies that manage our payment transactions to process your payment orders;
- Allow us and third parties to provide you with customized Services, for example by presenting them to you in your language or by presenting you with more targeted advertisements;
- obtain data such as your device model, operating system and screen size, other applications installed on your device and information about how you use our Services.

Otherwise, if you do not want us to collect data in the manner set out in this section, you should stop using our Services.
Advertisers sometimes use ad IDs to enable and enhance their advertising on mobile devices. Ad identifiers, such as the Android and/or Apple Ad Identifier (IDFA), are neither permanent nor personal and are intended to identify devices. When we advertise our Services on mobile devices, we may use your device's ad ID and other related information to help us serve ads that are relevant to your interests and to improve and measure the effectiveness of our ad campaigns. You can choose to prevent your Ad ID from being used to send targeted ads, or you can reset it by changing the settings on your device.
Payment information
When you purchase Services from our websites, we may collect some of your payment information on behalf of the companies that handle our payment transactions. Where applicable, this information will be temporarily cached so that we cannot read it ourselves. When you purchase items through our applications (for example, through the Apple App Store, Google Play Store, Windows Store, or Amazon Kindle Store), we do not collect or store any of your payment information.
4 Use of your Personal Information
4.1 You agree that we (or a supplier or other company within our group acting on our behalf and at our direction) may use your Personal Information to:
- contact you, for example, in connection with our user support services or to send you information about our Services;
- manage your account and our relationship, and enhance your experience using our Services;
- improve our Services, for example, by helping us to fix errors, bugs or by providing updates to our Services;
- interview you for surveys and interact with you, for example by sending you communications (including by e-mail) for these purposes;

5 Sharing your Personal Information with third parties
5.1 We will only share your data with third parties (e.g. other companies in our group or our suppliers) if:
- with your consent (including as set out in this Privacy Policy);
- where reasonably necessary to provide the Services to you (for example, by providing your Personal Information to suppliers we may use to provide the Services to you or to communicate with you);
- when we need to comply with your instructions (for example, to process a payment order, we need to pass on your Personal Information to the companies that handle our payment transactions);
- when your data is aggregated and anonymous, and therefore does not allow you to be personally identified;
- when you submit information as part of a competition or otherwise interact with our social networks (for example, by providing a testimonial regarding one of our Services), we may post that information, along with your name and country of residence, on our website(s) and social networks; in full compliance with the law in force;
- to comply with legal requirements, enforce or apply our terms of use and/or any other agreement we have with you;
- or protect the rights, property and safety of KYHU, our users or others;
- in the event of a sale of KYHU or the sale of KYHU's assets or a corporate reorganization, or as a result of a change in control or management of KYHU or any of its affiliates, or in contemplation of any of these events.Third parties to whom KYHU sells or transfers its assets will have the right to continue to use the personal and other information you provide to us in the manner set forth in this Privacy Policy. We will not sell or rent your information to third parties in circumstances other than those set forth here.
6 Interaction with social platforms or networks
6.1 You may allow our Services to interact with third party social platforms or networks (such as Facebook or Apple Game Center), which will provide us with information about you. These applications or websites are created and operated by third parties that are not part of KYHU and are not controlled by us. You should ensure that you read their terms of use and privacy policies to understand how these third parties process your data and what data they may share with us.
You understand that when you allow our Services to interact with third party social platforms or networks, we may share data about you with your contacts and other users of our Services (and vice versa) to enable you to play on social networks (hereinafter, your "Social Data"). This Social Data may include your name, your profile picture on the relevant social network, your activity status (including the time and date you last used our Services) and your scores and/or progress in our games.
You can change the data sharing permissions with a third-party platform or social network and prevent our Services from interacting with such social network or platform by adjusting the corresponding settings of the third-party provider. However, by doing so, you may not be able to use certain features of our Services.
Profile
We may assign users of our Services a profile that is visible to other users of our Services, some of which you may see on the progress map, leaderboards or similar features of our Games. Your profile may include the Social Data described above, game achievements or other game-related information, and information about other account holders who have accessed your profile.
Your profile will be visible to other users of our Services. In some of our Services, if you choose to view another individual's profile, that individual and other users of our Services will know that you have accessed it because some of your Social Data and a link to your profile will appear on that individual's profile. They may also be able to view your own profile.
7 How long we keep your information
7.1 We will retain your Personal Information for as long as necessary to carry out the purposes for which it was collected or to provide the Services to you. We may retain your Personal Information after your account has been closed or after we have provided the Services if such retention is necessary to comply with our legal or regulatory obligations, to resolve disputes between members, to prevent fraud, cheating or abuse, or to enforce this Privacy Policy or any other agreement we may have with a user.
Cat
Users of our messaging service may send messages to other account holders among their friends. We may retain your messages for the following purposes: (a) to deliver your messages; and (b) to allow you and your recipients to view your message history.
8 Transferring your Personal Information Abroad
8.1 Your Personal Information may be transferred to a country outside the European Economic Area ("EEA") and stored in that country. It may also be processed by staff based outside the EEA who work on our behalf or on behalf of one of our suppliers. We are committed to making every effort to ensure that your Personal Information is treated securely and in accordance with this Privacy Policy.

9.1 The security of your Personal Information is very important to us. We maintain appropriate technical and physical safeguards at all times to protect your Personal Information from accidental or unlawful destruction, loss or modification, unauthorised disclosure, unauthorised use or access, or other unlawful processing of the data in our possession. However, because the Internet is not a completely secure environment, we cannot guarantee that information you transmit via our Services will not be accessed, disclosed or destroyed as a result of violations of our safeguards.

10.1 Our Services may provide links to third party websites. You agree that when you click on these links, the data you provide on those sites is subject to their privacy policy, not ours. While we endeavour to link only to reputable websites, we expressly disclaim any responsibility for the content or security of third party websites.
11 Your rights regarding your Personal Information
11.1 You have the right to request a copy of the information we hold about you. If you wish to do so, please contact us at salut@olemains.com. We may charge a fee for this request.
It is important that your Personal Information is accurate and up-to-date at all times. You may request that we amend, correct or delete information about you by contacting us at the email address listed above.
When controlled by a third party social network or platform, we cannot edit or delete information you have shared through our Services on that third party social network or platform. In addition, if third parties copy information you have made available through your use of the Services (for example, a friend on a social network whom you have allowed to interact with your account), we may not be able to edit or delete that information because it may be beyond our control.

14.1 If any provision of this Privacy Policy is found by a court or other competent authority to be invalid or unenforceable, the remaining provisions shall not be affected.
This Privacy Policy is governed by and shall be construed in accordance with French law. Any disputes arising in connection with this Privacy Policy shall be subject to the exclusive jurisdiction of the French courts. We are constantly innovating and looking for new ways to improve our Services and Games. We may therefore change our Privacy Policy at any time to reflect such improvements or other changes in our business or for any other reason at our sole discretion. We will endeavour to inform you of material changes to our Privacy Policy if we believe that they may materially disadvantage you. If you do not agree to such changes, you must immediately stop using our Services and terminate your account(s) related to the use of our Services and Games.
